Rental Agreement

          www.heryerdevilla.com VILLA RENTAL AGREEMENT
 

  1. In this agreement, hereinafter referred to as 'Tenant', rents the villa/apartment, and the one renting out the villa/apartment is referred to as 'heryerdevilla.'
  2. This agreement is made between the Tenant and World Arges Travel for the rental of any apartment or villa listed on the website www.heryerdevilla.com and marketing channels of affiliated partners both domestically and internationally, for a pre-determined period with start and end dates.
  3. Through "www.heryerdevilla.com," and marketing channels of affiliated partners both domestically and internationally, the Tenant sends a request for the relevant villa or apartment, and upon payment of the advance and completion of the reservation, the Tenant and accompanying individuals implicitly accept the following conditions. Any violation of these conditions grants heryerdevilla the right to unilaterally cancel the reservation, request the Tenant to vacate the villa/apartment, and retain the payment.
  4. Tenants cannot transfer their rights and obligations arising from this agreement to third parties without the approval of heryerdevilla; World Arges Travel can transfer its rights and obligations arising from this agreement to third parties.
  5. For the reservation to be confirmed, a 20% or 50% of the total rental fee (depending on the villa/apartment) is collected as an advance payment. Upon completion of the advance payment, the Tenant is sent information regarding the reservation via email. With the completion of the advance payment, the Tenant acknowledges and accepts the terms and conditions of this agreement. The Tenant is obliged to pay the remaining amount in cash upon entering the relevant villa.
  6. If the Tenant wishes to leave after checking in, or leaves for any reason, no refund will be made.
  7. heryerdevilla issues a commission invoice for acting as an intermediary between the Tenant and the villa/apartment owner. heryerdevilla is not responsible for the remaining amount paid by the Tenant, as it is the income of the villa/apartment owner.
  8. There is no refund for the advance payment sent for the reservation, except in cases of prohibitions determined by the district governorship and governorship, such as war threat, terrorist activities, natural disasters, pandemic-related curfew, travel restrictions, etc.
  9. If the reservation is canceled by the villa/apartment owner or heryerdevilla.com, heryerdevilla is obliged to refund the entire advance payment made by the Tenant.
  10. heryerdevilla is an internet site that acts as an intermediary between villa/apartment owners and Tenants, and it does not accept any responsibility for issues that may arise regarding the rented villa/apartment (accidents, illnesses, fires, thefts, deaths, drownings, tours, shopping, food, entertainment, transportation, travel, power outages). heryerdevilla is responsible for promptly conveying Tenant complaints to the relevant individuals.
  11. Unless stated otherwise, no extra charge is requested for expenses such as pool and garden maintenance, electricity, water, and internet.
  12. Responsible personnel must enter and be present in certain areas at specific hours for the periodic maintenance of the pool.
  13. Unless stated otherwise, entry cleaning is included in the price for daily, weekly, and monthly rentals; for rentals longer than one week, weekly cleaning is included in the price. Additional requested cleanings are subject to an extra fee depending on the availability of cleaning companies.
  14. For some villa or apartment owners' specific requests, a cleaning fee may be requested for reservations less than 7 nights, or rentals less than 7 nights may not be allowed.
  15. The temperature of heated pools varies between 20 degrees Celsius and 28 degrees Celsius. In case the pool does not heat due to power outages, heryerdevilla is not responsible.
  16. heryerdevilla is not responsible for diseases and allergies arising from the water of the rented property's swimming pool and shower.
  17. heryerdevilla is not responsible for animals, pests, insects, and odors originating from animals, pests, insects, and fertilizers in or around the rented apartment/villa.
  18. A damage deposit is taken for the pool maintenance of villas/apartments categorized as private (not visible from the outside). The deposit is returned at the end of the stay if no damage occurs, and the house is left clean. If damage is detected during checkout, this damage is deducted from the deposit, and the remaining amount is refunded to the Tenant. If the deposit is not sufficient to cover the damage, the remaining amount is collected in cash from the Tenant at that moment.
  19. While the property is under the control of the Tenant, if it is not used like his/her own property in a clean, careful, and careful manner in accordance with the law and general moral rules and is not kept away from potential dangers, the visitor will be responsible for the damage in proportion to his/her fault, and heryerdevilla will not be liable under any circumstances.
  20. Tenants should be understanding towards neighbors and avoid any behavior or noise that may disturb the environment. Also, any illegal activities prohibited by law (weapons, drugs, all kinds of smuggling, etc.) should not be engaged in. In the event of such situations, heryerdevilla reserves the right to cancel the reservation without the need for a warning, request the evacuation of the house, and not refund the payment. This agreement ensures that the house cannot be rented to someone else on the specified dates due to these reasons. In case of disasters and force majeure, this agreement will be void.
  21. The villa or apartment's capacity specified on our website's detailed page must not be exceeded; if the number of people exceeds the specified capacity, the villa/apartment owner has the right to evict these people from the house or request an additional fee. Children over 2 years old are included in the number of people, and the count is calculated accordingly.
  22. Smoking and the presence of pets are not allowed unless otherwise specified for any villa or apartment.
  23. According to the Distance Contracts Regulation published in the Official Gazette on 22 November 2016, the Tenant is obliged to notify the personal information (ID card, driver's license, passport) of all persons who will stay in the villa/apartment to the authorized person designated by the company or the company itself before entering the villa/apartment.
  24. The entry time for villas is earliest at 16:00, and the exit time is latest at 10:00. The 6-hour time frame in between is reserved for cleaning. Late check-out or early check-in is allowed only in suitable cases.
  25. Tenants are advised to take out personal insurance policies covering life, health, theft, and travel during the rental period.
  26. In case Tenants engage in behavior that may disturb the surroundings or involve illegal activities during the rental period, heryerdevilla has the right to cancel the Tenant's reservation without a refund.
  27. Privacy fences in the pool of villas categorized as private (not visible from the outside) cannot be guaranteed 100%, and heryerdevilla is not responsible for any situations that may arise.
  28. heryerdevilla does not share the personal information of Tenants, such as name, surname, address, phone number, and email address, with third parties. These data are used for statistical purposes and campaign notifications. Efforts are made to prevent these data from falling into the hands of malicious individuals. Credit card information is not stored in the system for this reason. heryerdevilla is not responsible if these data fall into the hands of third parties due to cyberattacks.
  29. It is the responsibility of the Tenants to reach the rented apartment or villa.
  30. heryerdevilla is not responsible for dissatisfaction and problems that may arise from road, geographical location, decoration, and materials used in the rented villa/apartment.
  31. The geographical location data provided by heryerdevilla are approximate.
  32. heryerdevilla is not responsible for accidents, problems, deaths arising from the construction or facilities of the property; additionally, heryerdevilla is not responsible for health problems such as insect bites, poisoning, and allergies.
  33. In our villa/apartment options offered in nature, heryerdevilla is not responsible for problems that may arise from bugs and pests.
  34. heryerdevilla is not liable for changes in color, size, or some decoration items in the pictures on our website, resulting from alterations by villa/apartment owners.
  35. Rental conditions are fully valid in case of cancellation of leave for public or private company employees.
  36. In case of irreparable damage originating from the rented property, payment is made by calculating the number of days not stayed, and the fee for the days stayed is not refunded.
  37. The Tenant is obliged to check in on the agreed-upon date and make the remaining payment. If the Tenant wants to check in on a different date during the reservation period, the Tenant is obliged to pay the full remaining reservation fee on the original start date. In case of non-payment, heryerdevilla has the right to resort to legal action.
  38. In accordance with the Distance Contracts Regulation, the Tenant cannot exercise the right of withdrawal in any way.
  39. By accepting this agreement, the Tenant is deemed to have read and accepted the terms and conditions. Any behavior contrary to these terms and conditions gives heryerdevilla the right to unilaterally cancel the reservation, not refund the payment, and demand the entire fee.
  40. Severability: If any provision or part of this agreement is or becomes legally invalid, and it is understood that the remaining provisions of the agreement have legal effectiveness without this provision or part, it will only be valid for that provision or part, and will not affect the validity or enforceability of the remaining provisions of the agreement.
  41. The Tenant is deemed to have accepted the "Privacy and Security Policy" with this agreement.
  42. Fethiye Executive Offices and Courts are authorized in disputes related to this agreement.
